Learned counsel for the petitioner has challenged the impugned order dated 17.12.2024, and has submitted that the same is perverse, arbitrary and bad in law. 2. On perusal of the finding referred to in ‘para-29-30’ of the impugned order dated 17.12.2024, this Court does not find any perversity, considering that; the petitioner was medically unfit as he was posted on the post of Blast Assistant; that he was not alternatively engaged in any other employment and that whatever is paid, was permitted in the award, passed by the learned Tribunal. The relevant extract of the impugned order dated 17.12.2024 as reproduced as below: “29. अनुतोष- 30. चारणीय ु संा-1 के नय के आधार पर यह माणत आ है क प ी !ारा नांक 07.07.2010 को ा"# [2026:RJ-JP:4262] (2 of 3) [CW-20784/2025] की मेडीकल ोड& से करायी गई परी ा के पात ह त)ालक प ( *ा+र सहायक) पर शारी-रक असम"&ता के कारण काय& करने हेतु असम"& पाया गया। त/ात नांक 11.11.2010 को ैक01क रोजगार समत !ारा ा"# के लये कोई ैक01क रोजगार उपल4 होना नहीं पाया गया। कं तु प ी !ारा इस 06त म7 ा"# को अधसं (Supernumerary) प सृजत करते ये उस प के 9: नयोजत नहीं कया गया। प ी का इस कार ा"# को नयोजत न करना ध स;त नहीं है। . 15.07.2013 के उपरांत ा"# के शारी-रक 9प से ैक01क रोजगार हेतु सम"& होने पर भी उसे ैक01क 9प से रोजगार उपल4 नहीं कराया गया। इस 06त म7 =मक ंशीधर को . 07.07.2010 से 15.07.2013 तक अधसं (Supernumerary) प पर नयोजत मानते ये प ी से त>मय ेय ेतन भ?ों का ना ाष&क ेतन ृ0: ये भुगतान ा@ करने का अधकारी घोषत कया जाता है। नांक 16.07.2013 से ा"# को काय& पर उप06त मानते ये ाष&क ेतन ृ0: ा@ करने का अधकारी माणत पाया जाता है। अतः . 16.07.2013 से 31.03.2015 तक =मक ंशीधर को ाष&क ेतन ृ0:यों सहत ेतन एं प-रलाभों का भुगतान प ी !ारा कया जाे। इस अधनण&य म7 ये गये नDशानुसार सेा नृ? त" पर =मक का ेतन नधा&रण पुनः कया जाकर पू& म7 भुगतान की गई राश को समायोजत करते ये ेय प-रलाभों ( FेGुटी सहत) का नधा&रण कर भुगतान कया जाे। प ी इस आेश का अनुपालन अधनण&य के भाी होने की त" से ो माह की अध म7 करे अI"ा ा"# ेय राश पर 9 तशत ाष&क Jाज की र से Jाज भी ा@ करेगा।” [2026:RJ-JP:4262] (3 of 3) [CW-20784/2025] 3.
