(At Present Confined In Sub Jail Bandikui, District Dausa, Rajasthan.) ----Petitioner Versus The State of Rajasthan, through PP ----Respondent For Petitioner(s) : Mr. Sukhdev Singh Solanki For Respondent(s) : Mr. Rhishi Raj Singh Rathore, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 12/01/2026 1. The instant bail application has been filed under Section 483 of BNSS on behalf of accused-applicant. The accused- applicant was arrested in connection with FIR No. 376/2019 registered at Police Station Bandikui District Dausa for the offence(s) under Sections 420, 406, 467, 468, 471 & 120-B of IPC. 2. Learned counsel for the accused-applicant has fairly submitted that the contention that the co-accused was granted bail was incorrectly advanced on the erstwhile date. Upon perusal of the order, it is apparent that the said contention was not taken into consideration and that bail was granted on other grounds. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. [2026:RJ-JP:1197] (2 of 2) [CRLMB-16708/2025] 4. Considering the arguments advanced by the counsel for the parties, considering that charge-sheet has been filed and the trial will take its own time to conclude; that the applicant has been in custody ever since 26.10.2025 and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the second bail application of the accused-applicant and enlarge him on bail. 5. Accordingly, the bail application under Section 483 Cr.P.C. is allowed and it is ordered that accused-applicant Rahul S/o Shivprakash shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
