Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No.28 of 2024, registered for the offence under Sections 379, 411, 419, 420 & 34 of the IPC, under Section 21 of MM (D & R) Act, 1957, Rule 54 of JMMC Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 and the case is pending in the court of learned ACJM, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioner submits that petitioner has been implicated in the case alleging therein that on the instruction of the petitioner, sand was being carried on in the Tractors. 4. He next submits that the person/ co-accused who has signed the Challan has been granted anticipatory bail by this Court vide order dated 19.01.2026 in ABA No.224 of 2026. Further, the petitioner has no criminal antecedent as disclosed in Para-20 of this petition. 5. Learned counsel appearing for the State has opposed the prayer and submits that on the instruction of the petitioner, the sand was being carried on in the Tractor(s). As such, petitioner may not be enlarged on anticipatory bail. 6. The only allegation made against the petitioner that on the instruction of petitioner, the sand was being carried on the tractor(s) and the person/ co-accused who had issued the forged challan has already been enlarged on anticipatory bail in the aforesaid ABA and that the petitioner has no criminal antecedent as disclosed in Para-20 ( 2026:JHHC:21362 ) 2 of this petition, I am inclined to provide privilege of anticipatory bail to the petitioner. 7. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from the date of receipt of a copy of this order and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of ACJM, Palamau at Daltonganj, in connection with Ramgarh P.S.
