1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.137/2026 registered at Police Station – Chuikhadan, District-Kahiragarh-Chuikhdan-Gandai (C.G.) for the offences punishable under Sections 75(1), 778, 79 of BNS, 2023. Prosecution story, in brief is that the complainant lodged a written report on 15.04.2026 that she (complainant) was posted as Chief Executive Officer at Janpad Panchayat Chhuikhadan since 06.10.2025. Within a few days, the present applicant who is elected Janpad Member and presently he is Shabhapati began visiting her office and making inappropriate personal remarks. He pressured her to cooperate with him and, upon refusal, threatened her with consequences similar to those allegedly faced by a former CEO. The accused repeatedly contacted her through calls and messages, causing harassment and mental distress. He often entered her cabin during office hours, created disturbances, and demanded that she establish physical relations with him. He also threatened her and claimed knowledge of her residence, which further intimidated her. Due to continuous harassment, threats, and interference in her personal life, the complainant informed her family and blocked his number. On the basis of her complaint, an FIR was registered against the accused under relevant provisions of the Bharatiya Nyaya Sanhita. Hence this bail application.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case due to personal and political rivalry. It is submitted that the allegations levelled against the applicant are false, exaggerated, and devoid of any substantive material. He further submits that the applicant is a public representative and an elected Janpad Member presently holding the post of Sabhapati and owing to
3 official and administrative interactions, he used to visit the office of the complainant in connection with public work and developmental activities of the Janpad Panchayat. The allegations regarding inappropriate remarks, threats, and demand for physical relations are wholly baseless and have been levelled with mala fide intention to tarnish the image and reputation of the applicant. It is further submitted that no independent witness has supported the allegations made by the complainant and there is no material on record to corroborate the alleged incidents. Learned counsel submits that the FIR has been lodged after considerable delay and the same appears to be an afterthought. Learned counsel also submits that the applicant has been continuously raising complaints and making official correspondence regarding serious financial irregularities and alleged bogus budgeting in Janpad Panchayat Chhuikhadan. and he has produced some documentary Evidence of Complaints several written representations, letters, and official communications submitted by the applicant to competent authorities clearly establish that he has been actively pursuing action financial and against corruption misconduct. Copies of letters and complaint made by the applicant is being filed as ANNEXURE A/2 COLLY. The applicant is ready and willing to cooperate with the investigation/trial and abide by all conditions that may be imposed by this Hon’ble Court, therefore applicant is entitled to grant of anticipatory bail. 4

On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submits that complainant in the present case is Chief Executive Officer, Janpad Panchayat Chuikhdan and the applicant who is elected Janpad Panchayat harassing her again and again and asking her to co-operate with the proceedings. She further submits that as per the statement recorded under Section 183 of BNSS of the complainant, wherein she stated that applicant pressurized her to cooperate with him and, upon refusal, threatened her with consequences similar to those allegedly faced by a former CEO.

Due to continuous harassment, threats, and interference in her personal life, the complainant informed her family and blocked his number. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the allegations, it is evident that the accused continuously harassed and intimidated the complainant by repeatedly contacting her through calls and messages, creating disturbances at her workplace, and pressuring her to establish physical relations with him. The allegations further reveal that the accused threatened the
5 complainant and used his knowledge of her residence to instill fear and insecurity in her mind. The conduct attributed to the accused reflects a deliberate pattern of harassment and interference in the complainant’s personal and professional life, resulting in severe mental distress. In view of the seriousness of the accusations and the possibility of influencing or intimidating the complainant, this Court does not find it to be a fit case for grant of anticipatory bail to the accused. 7. Accordingly, the anticipatory bail application of the applicant– Sudheer Golcha filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.137/2026 registered at Police Station – Chuikhadan, District-Kahiragarh- Chuikhdan-Gandai (C.G.) for the offences punishable under Sections 75(1), 778, 79 of BNS, 2023, is rejected.
