VIBHU BAKHRU, CHIEF JUSTICE) 1. The petitioner has filed the present petition impugning the proceedings bearing No.PCB/01/ECM/2026-27/112 dated 09.04.2026 passed by the State Level Enforcement Committee, Karnataka State Pollution Control Board [KSPCB] recommending closure of the petitioner's Units. The petitioner also seeks an order directing the Karnataka State Pollution Control Board to consider its application for renewal of Consent for Operation [CFO] and to issue - 3 - HC-KAR NC: 2026:KHC:27910-DB WP No. 14716 of 2026 the same with respect to Unit-II in terms of the recommendation of the Environmental Officer, Karnataka State Pollution Control Board dated 16.07.2024. 2. The petitioner is essentially aggrieved by the recommendation made by the State Level Enforcement Committee recommending closure of Units-I and II of the petitioner. It is contended by the learned Senior Counsel for the petitioner that the said recommendation was made without affording the petitioner an opportunity of hearing and without providing the material on the basis of which, such recommendation has been made. 3. The learned counsel appearing for the Karnataka State Pollution Control Board submits that no final decision has been taken for closure of the two units of the petitioner-company. He submits that the proceedings setting out the grounds proposed for such closure would be issued and the petitioner would be at liberty to submit its representation/objections in this regard. He submits that a fresh inspection of the units would be conducted and report of the same would be provided to the petitioner. If any deficiencies noticed, the details of the same would be communicated to the - 4 - HC-KAR NC: 2026:KHC:27910-DB WP No. 14716 of 2026 petitioner and thereafter an appropriate final decision would be taken after affording an opportunity of hearing to the petitioner. 4. In view of the said statement, no orders are required to be passed in the present petition. The petition is accordingly disposed of. 5. The pending interlocutory applications also stand disposed of.
