Order 05/02/2026
1. The instant writ petition has been filed by the petitioner with the following prayers:-

[2026:RJ-JP:5596] (2 of 4) [CW-20048/2025] and Udaipur District, till the completion of project, with all consequential benefits. (ii) Any other appropriate writ, order of direction which this Hon’ble Court may deem think fit and proper may kindly be passed in favour of the petitioner. (iii) Costs of the writ petition may kindly be awarded in favour of the petitioner.”
2. The petitioner was assigned the work under the contract agreement signed by the parties. The respondents issued an NIT No.29/202-/21 for Selection of Implementation Support Agencies (for short ‘ISA’) for carrying out the support activities for Sawai Madhopur District of Rajasthan State under the Jal Jeevan Mission (for short ‘JJM’). In Section 2 of the NIT, general conditions of the contract have been provided. Condition No.20 in Section 3 of the NIT, special conditions of contract, provides for the duration of the contract period, which reads as under:-
“20. Period of award of the work:- The selected ISAs are to be engaged for duration of four years or till the completion of the JJM period. The continuance of engagement of agency will depend on the Performance Review by SWSM. The Project Cycle Duration for each village shall be 18 months and the selected ISAs shall deploy teams, as per the BID document, to carry out the work in a cluster of 50-60 villages at a time.”
3. As per the Condition No.20 in Section 3 of the NIT, special conditions of contract, the selected ISA is engaged for a duration of four years, which can be extended till the completion of the JJM period. The condition provides the period of contract as four years and is now complete. Now, the prayer is for extension of the contract till the completion of the JJM Period. 4.
On perusal of the Condition No.20 in Section 3 of the NIT, special conditions of contract as regards the duration of the contract, the true and spirit meaning is of the said condition is
[2026:RJ-JP:5596] (3 of 4) [CW-20048/2025] that the ISA can be engaged for a basic duration of four years, however, in case the work of the selected ISA is found to be upto the mark, then it can be extended for further period. 5. During course of the arguments, the learned counsel for the petitioner has submitted that the period of JJM came to an end, however, the period of project has been extended now. 6. Since, the direction for which the petitioner ISA was selected is over and the period of four years is also over, hence, the petitioner cannot claim further extension as a matter of right. 7. One of the submissions made by the learned counsel for the petitioner is that since in the condition, as regards the period of work, it has been mentioned that the selected ISA could be engaged till the completion of the JJM period and, therefore, the petitioner should be allowed to continue the work as the project is still continuing. 8. When the respondents in the NIT has laid a specific condition that the selected ISAs are to be engaged for a duration of four years or till completion of JJM period, it means that the period of of engagement would be four years, which can be extended further, if the respondents deem proper. 9. The petitioner cannot claim the extension as a matter of right as in the condition, it has been provided that the period may be till completion of the JJM period. If the arguments of the
learned counsel for the petitioner is accepted, then there would have been no occasion for the respondents for prescribing the period of engagement as four years. The Court has interpreted the Condition No.20 in Section 3 of the NIT, special conditions of contract, as regards the condition of the period, in true and spirit
[2026:RJ-JP:5596] (4 of 4) [CW-20048/2025] manner and in opinion of this Court, the condition prescribing the period of engagement as four years, can be extended, if need arises.
10. Taking into consideration the general conditions of the contract in between the petitioner and the respondents, the Court finds no merit in the claim of the petitioner.
11. Accordingly, this writ petition is dismissed being devoid of merit.
12. The stay application and pending application, if any, also stand disposed of.
