This writ petition has been filed under Article 226 of the Constitution of India, whereby the petitioner has challenged the order dated 07.01.2026 (annexure no.1) and impugned notice/letters dated 22.01.2026 and 02.02.2026 (annexure no.2) issued by respondent no.3-M.D.D.A. 5. It is informed by learned counsel for respondent no.3-M.D.D.A. that against the order dated 07.01.2026 appeal is preferred by the petitioner before the Commissioner, Garhwal Division being Appeal No.35 of 2025-26, International Herbal Corporation Pvt. Ltd. Vs. M.D.D.A., wherein notices have been issued and the record has also been summoned by the Appellate Authority. 6. By means of the present writ petition, the petitioner wants to get the interim relief to the fact that the order impugned in the appeal be stayed during pendency of the appeal. 7. Such a prayer is preposterous for the reason that similar prayer is pending before the Appellate Authority. 8. In such view of the matter, this Court finds no good ground to interfere in the matter. 9. Accordingly writ petition stands dismissed; however it is directed that the Commissioner, Garhwal 2026:UHC:767 Division shall expedite hearing of the interim relief application/stay application filed by the petitioner in appeal.
