[2026:RJ-JP:1692] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 16872/2025 Suresh Kumar Chouhan S/o Shri Chhotayee, Aged About 67 Years, R/o Village Babhani, Police Station Chiliya, District Siddharth Nagar, (U.p.) Present At Raythal, Police Station Kaladera, District Jaipur. (At Present Lodged In The Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ashvin Garg For Respondent(s) : Mr. Rajesh Choudhary, GA-cum-AAG with Mr. Manvendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 15/01/2026 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.229/2025 registered at Police Station Kaladera, District Jaipur Rural for offences under Sections 319(2), 318(4), 106(1) of BNS, 2023 and Sections 15(2) and 15(3) of Indian Medical Council Act, 1956. 2. Heard learned counsel for the petitioner as well as learned Government Advocate-cum-Additional Advocate General and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that though allegation levelled against the petitioner is that he was operating the medical hospital without any registration, in which due to negligent treatment death of the deceased took place. But this fact was not questioned that treatment given to deceased was [2026:RJ-JP:1692] (2 of 2) [CRLMB-16872/2025] by well-qualified Doctor who holds the valid degree of MBBS and entitled to the practice. He contends that it was not the case of the complainant side that petitioner himself has given the treatment to the deceased. He averred that because of non- registration of the hospital he is facing continuous custody. Petitioner is behind the bars since 07.11.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence, the bail application of the petitioner may be allowed. 4. Learned Government Advocate-cum-Additional Advocate General has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Suresh Kumar Chouhan S/o Shri Chhotayee, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
