JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioner filed this writ petition challenging the order of termination. 2. Learned counsel for the respondents submits that the writ petition filed by the petitioner is not maintainable as the petitioner has got an efficacious remedy under Rule 26(10) of the First Statues of the National Institute of Technology. He submits that the petitioner without exhausting efficacious remedy, filed this writ petition and to buttress his arguments, he has placed reliance on the judgment of the Hon'ble Apex Court in the case of RIKHAB CHAND JAIN VS. UNION OF INDIA AND OTHERS reported in CIVIL APPEAL NO.6719/2012 disposed off on 12.11.2025. Hence, on these grounds, he prays to dismiss the appeal. 3. After arguing the matter for sometime, learned counsel for the petitioner seeks leave of this Court to - 4 - HC-KAR NC: 2026:KHC:27658 WP No. 13662 of 2026 withdraw the petition with liberty to approach the Appellate Authority under Rule 26(10) of the First Statues of the National Institute of Technology. 4. The submission is placed on record. 5. Accordingly, the writ petition is dismissed as withdrawn with the liberty to approach the Appellate Authority. If the petitioner approached the Appellate Authority, the petitioner is entitled for benefits of Section 14 of the Limitation Act. 6. All the contentions of the parties are kept open. 7.
