The petitioners are apprehending their arrest in connection with Kunda P.S. Case No.12 of 2026, for the alleged offences registered under Sections 126(2), 115(2), 117(2), 109(1), 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Deoghar. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and both the sides are agnates. He further submits that the dispute taken 2026:JHHC:21356 --2-- A.B.A. No. 3930 of 2026 place due to land dispute. He then submits that there are general and omnibus allegation against all the accused persons and there are case and counter case between the parties. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of assault and pursuant to that injury has been received by the uncle of the informant and in view of that anticipatory bail may kindly be rejected. 5. On perusal of the FIR it transpires that there is direct allegation of assault against petitioner No.1 namely Manoj Kumar Thakur @ Manoj Thakur and pursuant to that injury has been received by the uncle of the informant and in view of that I am not inclined to provide anticipatory bail to the petitioner No.1 namely Manoj Kumar Thakur @ Manoj Thakur. Hence, the prayer for anticipatory bail of the petitioner No.1 namely Manoj Kumar Thakur @ Manoj Thakur is hereby rejected. 6. So far petitioner Nos.2 to 6 are concerned, there are general and omnibus allegation against them and there are case and counter case and further it has been pointed out that both the sides are agnates and the altercation took place due to land dispute and in view of that I am inclined to provide anticipatory bail to the petitioner Nos.2 to 6 namely Sabir Thakur @ Sabir Kumar Thakur, Ashok Thakur @ Ashok Kumar Thakur, Binay Thakur @ Binay Kumar Thakur, Anil Thakur @ Anil Kumar Thakur and Malik Thakur respectively. 2026:JHHC:21356 --3-- A.B.A. No. 3930 of 2026 7. Accordingly, the petitioner Nos.2 to 6, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioner Nos.2 to 6, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Deoghar in connection with Kunda P.S.
