The applicant has preferred this First Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as they have been arrested in connection with Crime No.33/2026, registered at Police Station - Bhilai Bhatti, District - Durg (C.G.) for the offence punishable under Section 22(b) of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’). 2. The prosecution story, in brief, is that on 24.02.2026 at about 7:00 PM, the police received secret information that two persons were standing near Sector-1 Pump House, Bhilai, carrying bags containing Alprazolam tablets and were waiting for customers to sell the same. 2 reached the spot and apprehended the present applicant along with co-accused Atul Yadav. It is alleged that from a black-coloured bag carried by the present applicant, 85 strips containing 850 Alprazolam tablets weighing 357 grams were recovered. It is further alleged that from a black-grey coloured bag carried by co-accused Atul Yadav, 80 strips containing 800 Alprazolam tablets weighing 335 grams were recovered. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted the applicant is only 22 years old, a young boy and studied class 12th and ITI. He also submits that the applicant has no previous criminal antecedents and the charge-sheet has been filed. He later submits that the applicant is in jail since 25.02.2026. The conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the charge-sheet has been filed.
He further submits that from the perusal of the record, it appears that from the possession of the applicant/accused Sagar Singh Rajput, 85 strips were recovered, each strip containing 10 tablets, totaling 850 tablets having a total weight of 357 grams, further, from the possession of other co-accused Atul Yadav, 80 strips were recovered, each strip containing 10 tablets, totaling 800 tablets weighing 335 grams. Thus, jointly, a total of 692 grams of narcotic substance Alprazolam tablets was recovered and seized, which is much more than the commercial quantity. Hence, his bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 3

Taking into consideration the facts and circumstances of the case, nature of allegations and the material available on record, the fact that quantity of narcotic substances which has been seized from the possession of the applicant, is much more than the commercial quantity, and the applicant has failed to give any explanation for the same and it cannot be said to be a case of false implication, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant – Sagar Singh Rajput involved in Crime No.33/2026, registered at Police Station - Bhilai Bhatti, District - Durg (C.G.) for the offence punishable under Section 22(b) of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’), is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. The Office is directed to provide a certified copy of this order to the trial Court for necessary information and compliance forthwith. Sd /- Sd/-Sd
