ORAL ORDER Accused No.2 in Special C.No.5006/2023 pending before the Court of II Additional District and Sessions Judge, Bengaluru South District, Sitting at Kanakapura, arising out of Crime No.161/2021 registered by Harohalli Road Police Station, Ramanagara for offences punishable under Section 307 read with Section 34 of Indian Penal Code (for short 'IPC') is before this Court in this petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking regular bail.
2. Heard the learned counsel appearing for the petitioner and learned High Court Government Pleader on behalf of respondent.

Learned counsel for the petitioner submits that on the merits of the case, the petitioner who was arrested in the present case, was earlier granted regular bail in Criminal Misc.

No.5277/2021 disposed off on 08.10.2021. For the reason that the petitioner had not appeared before the Trial Court on the regular dates of hearing, he is now arrested and remanded to custody on 15.12.2025. After the petitioner was granted bail in the present case, has not involved himself in any other cases till today and the petitioner is ready and willing to co-operate before the Trial Court. Accordingly, he prays to allow the petition.
4. Per contra, learned High Court Government Pleader has opposed the petition and prays to reject the prayer of the petitioner.
5. Material on record would go to show that the petitioner who was arrested in the present case earlier was granted regular bail by the jurisdictional Sessions Court in Criminal Misc. No.5277/2021 disposed of on 08.10.2021.

Order sheet of the Trial Court in the present case would go to show that since the petitioner had not appeared before the Trial Court on the regular dates of hearing non- bailable warrant was issued as against him and his presence was secured on 15.12.2025 and on the said day he was

remanded to judicial custody. The petitioner who was earlier granted regular bail in the present case is now in the custody for last nearly six months. It is not in dispute that he has not involved himself in any other case after he was granted regular bail in the present case earlier.
7. For the mistake committed by the petitioner by not appearing before the Trial Court on the regular dates of hearing he has been sufficiently punished. He has undertaken to co-operate before the Trial Court for disposal of the case.
8. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail has to be answered in the affirmative.
9. Accordingly, the following:
ORDER The petitioner/accused No.2 is directed to be enlarged on bail in Special C.No.5006/2023 pending before the Court of II Additional District and Sessions Judge, Bengaluru South District, Sitting at Kanakapura, arising out of Crime No.161/2021 registered by Harohalli Road Police Station,

Ramanagara for offences punishable under Section 307 read with Section 34 of IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) Petitioner shall not involve in similar offences in future;
e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
