petitioners were earlier granted regular bail on surrender during investigation. He further submits that now the charge-sheet has been submitted and cognizance has been taken under Section 307 of Indian Penal Code and now the petitioners have received summon. He then submits that the correct procedure will be to appear before the learned Court. He next submits that he may kindly be allowed to appear before the learned Court and remain on bail as he has already been granted bail.
4.
Learned counsel appearing for the State opposed the prayer and submits that the petitioners have unnecessarily filed the anticipatory bail in spite of appearing before the learned Court.
5. The petitioners have already been granted regular bail on surrender and thereafter under Section 307 of Indian Penal Code cognizance has been taken and the correct procedure should be that the petitioners are required to appear before that Court.
6. In view of the above, the petitioners are directed to surrender before the learned Court within two weeks from the date of this order and he will furnish undertaking that he will cooperate with the trial of the case and will appear as and when his appearance is required by the learned Court and the learned Court shall allow the petitioners to remain on bail as granted earlier.
7. This application is disposed of.
