1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.26/2026 registered at Police Station – Chouki- Sonkyari, Police Station-Sanna, District-Jashpur (C.G.), for the ARPAN SRIVASTAVA Digitally signed by ARPAN SRIVASTAVA Date: 2026.05.08 16:35:47 +0530
2 offence punishable under Sections 4, 6, 10 of Chhattisgarh Pashu Parirakshan Adhiniyam. 2. That, the prosecution story, in brief, is that on 01.04.2026, while the police party was on routine patrolling duty, they received information from an informant that the accused persons, namely Thomas Xalxo, Basant Xalxo and Vipin Toppo, were transporting 12 cattle towards a slaughter house. Acting upon the said information, the police intercepted and apprehended the accused persons along with the cattle. Thereafter, the cattle were seized and a crime was registered against the applicants for the aforesaid offences. 3. That the applicant is innocent and has been falsely implicated in the present case. The applicant is nowhere involved in transporting cattle towards any slaughter house and no cattle have been recovered from his possession. The entire prosecution case is false and fabricated, and the applicant has been arrayed as an accused merely on suspicion without his presence at the spot of incident. The alleged cattle were recovered from the joint possession of other co-accused persons and do not belong to the present applicant. The applicant is a reputed person, having permanent residence and
3 movable/immovable property, and undertakes to abide by all conditions imposed by this Hon’ble Court, therefore, he submits that the present applicant is also entitled to be released on anticipatory bail. 4. The State strongly opposes the bail application as the applicant is actively involved in the alleged offence and is part of an organized act of illegal transportation of cattle for slaughter. The contention of false implication is baseless and is not supported by the material collected during investigation.
The recovery of 12 cattle and the circumstances clearly establish the involvement of the accused persons acting in concert, and the applicant’s presence cannot be ruled out at this stage. The offence is serious in nature and has wider implications affecting public order and law. Hence, the applicant does not deserve the benefit of bail
5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the rival submissions of learned counsel for the parties, the nature of accusation, material available on record and the fact that investigation in the matter is complete and charge-sheet has been filed, it appears that the applicant has
4 been implicated on the basis of suspicion and no specific role has been assigned supported by independent corroborative evidence. It is also not in dispute that the applicant is a permanent resident of the area and there is no material to suggest that he is likely to abscond or tamper with the prosecution evidence. In the aforesaid circumstances, without expressing any opinion on the merits of the case, this Court is of the view that it is a fit case to extend the benefit of bail to the applicant. Accordingly, the application is allowed. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Hasan Ansari, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting OfÏcer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till
5 disposal of the trial.
(d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve himself in any offence of similar nature in future. Sd/-
