Respondent(s) For Appellant : Mr. Vipin Singh Thakur, Advocate For Respondent No.3 Mr. Pravesh Sahu, advocate Hon'ble Shri Justice Sachin Singh Rajput, Order on Board 05.05.2026 2 1) This appeal under Section 173 of Motor Vehicles Act, 1988 (for short “ MV Act”) has been filed by the appellant/claimant being aggrieved by the award dated 06.04.2023 passed in Claim Case No. 545/2021 by the learned 4th Additional Motor Accident Claims Tribunal, Bilaspur, District Bilaspur (CG). By the impugned award the learned Tribunal has awarded Rs. 2,31,664/- in favour of the appellant/claimant as compensation on account of grievous injuries received by him which took place on 09.01.2018 by the rash and negligent driving of respondent no. 1/driver of the offending vehicle i.e. Sarvo Sartaj Mazda bearing registration No. CG-10-C-9746. 2) Learned counsel for the appellant submits that the amount awarded by learned tribunal is on the lower side which may be suitable enhanced. 3) Learned counsel for the respondents opposed the submission made by the learned counsel for the appellant and supports the award and submits that just compensation has been awarded. 4) I have heard learned counsel for the parties and perused the record. 5) On perusal of record & evidence available, this Court deems it fit to award further sum of Rs. 50,000/- to make the compensation just. 6) Respondent No. 3 is directed to deposit an additional sum of Rs. 50,000/- within a period of 60 days from today, otherwise it will be liable to pay interest of @6% from the date of this order. 7) Consequently, the appeal is partly allowed.
