JUSTICE BIPIN GUPTA Judgment / Order 27/01/2026 1. The present writ petition has been filed by the assailing order dated 06.11.2025, passed by learned Senior Civil Judge, Shahpura, District Jaipur, whereby the learned trial court in spite of not having any application preferred by the respondents- plaintiffs seeking exemption for taking LRs on record has exempted them from substitution of the LRs of defendant No. 5 and rejected the application of respondents-plaintiffs to take the legal representatives on record. 2. Learned counsel for the petitioners further submits that the learned trial Court has wrongly exercised its power in dealing with this application, without considering the interests of any of the parties. It is contended by learned counsel for the petitioners that since their mother was a party to the suit as defendant No. 5, and an application was filed by the plaintiffs to implead the legal representatives of defendant No. 5 on record, with no separate application filed by the plaintiffs seeking exemption of any nature, the petitioners ought to have been impleaded as parties to the suit. 4. Per contra, learned counsel for the respondents do not dispute the fact that they have filed an application to take the legal representatives of defendant No. 5 on record as well as the fact that they had sought no exemption from the learned trial Court for not taking the legal representatives of defendant No. 5 on record. [2026:RJ-JP:3548] (4 of 4) [CW-410/2026] 5. Heard. 6. Considering the same, this Court finds that the impugned order dated 06.11.2025 was passed by the learned trial Court without any specific application from the plaintiffs seeking exemption. The trial Court should have allowed the plaintiffs- respondents’ application seeking permission to take the legal representatives of defendant No. 5 on record. 8. Therefore, this Court finds that the order dated 06.11.2025 cannot be sustained. The same is hereby quashed and set aside. The application filed by the respondents-plaintiffs under Order 22 Rule 4 CPC is allowed. The petitioners are permitted to be taken on record as LRs of defendant No. 5. 9. The learned trial Court is free to pass any appropriate order on whether the petitioners can be granted the right to file a reply. 10. With these observations, the present civil writ petition stands disposed of. 11. Pending application(s), if any, also stands disposed of. (BIPIN GUPTA),J Sudha/Kratika/20
