ORAL ORDER Accused Nos. 2 and 4 in Crime No. 296/2025 registered by Banashankari Police Station, Bengaluru, for the offences punishable under Sections 61(2)(a), 331(7), 331(8), 332(b), 307, 109(1), 309(6), 311 read with Section 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 (hereinafter referred to as 'BNS, 2023' for short), are before this Court in this bail petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. - 3 -

2. Heard the learned counsel for the petitioners and the learned HCGP for the respondent/State. 3. FIR in Crime No. 296/2025 was registered by the Banashankari Police Station, for the aforesaid offences against one Madivala @ Myadi, Ganesha and others, based on the first information dated 15.09.2025 received from Smt. Kanaka Pushpa, who is the alleged victim in the present case. During the course of investigation, petitioner No. 1 herein was arrested on 15.09.2025 and petitioner No. 2 herein was arrested on 01.10.2025. After completing investigation, charge sheet has been filed against 4 persons. Petitioners herein are arraigned as accused Nos. 2 and 4 in the charge sheet. Their bail application filed before the jurisdictional Sessions Court in Crl. Misc. No. 11580/2025 was rejected on 14.01.2026. Therefore, they are before this Court. 4. In the first information which was submitted by the victim lady, she has stated that on 14.09.2025 at

about 21.30 hours, accused No.1 - Madivala @ Myadi, who was earlier working as a driver with her son, along with others had entered into her house and after showing deadly weapons to her, asked her to hand over the key of the almirah and when she informed them that she did not have the key, one amongst them allegedly assaulted her on her neck with a knife. Accused No.1 thereafter threatened her with dire consequences and the other accused persons searched her house and left the house along with the original documents of certain properties, some cash and also gold jewelry. 5. During the course of investigation, accused Nos. 1, 2 and 4 have been arrested. It is not in dispute that petitioners who are arraigned as accused Nos. 2 and 4 in the present case do not have any criminal antecedents.
Investigation of the case is completed and charge sheet has been filed. Accused No. 1 in the present case has been granted regular bail by the Co-ordinate Bench of this Court in Crl.P.No. 2778/2026 disposed of on 10.04.2026. - 5 -

Allegation of assaulting the injured victim on her neck with a knife is found against accused No. 3. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:
ORDER The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No. 296/2025 registered by the Banashankari Police Station, Bengaluru, for the offences punishable under Sections 61(2)(a), 331(7), 331(8), 332(b), 307, 109(1), 309(6), 311 read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Each petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is
disposed of.
