The petitioner is apprehending his arrest in connection with Complaint Case No.356/2025 dated 07.03.2025, registered for the offence under Sections 33(1)(b)(c) of the Indian Forest Act, pending in the Court of the learned S.D.J.M., Chatra. 3. Learned counsel appearing for the petitioner submits that false allegations are made against the petitioner of excavating soil from forest land. She next submits that in the offence report itself, it has been disclosed that accused nos. 2 and 3 are contractors. She also submits that the petitioner has nothing to do with the said excavation of soil. She further submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 11 of this application. On these grounds, she submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of excavation of soil from forest land in view of that, the prayer for anticipatory bail may kindly be rejected. In the offence report, the allegations are made against accused nos. 2 and 3 alleging that they are contractors and they were involved in excavation of soil. The person, who has disclosed the name of the petitioner, that person’s name is not disclosed in the offence report. Further, the petitioner is having no criminal antecedent, as disclosed in paragraph 11of this application. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Chatra in connection with Complaint Case No.356/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
