The DCP concerned had appeared and had tendered the reply and explanation due to which delay was caused in filing the chargesheet. 2. By way of the present petition, the petitioner is seeking quashing of FIR bearing no. 154/2023, registered at Police Station Malviya Nagar, Delhi for the commission of offence punishable under Sections 323/341/427/34 of Indian Penal Code, 1860 (hereafter 'IPC’) on the basis of settlement. The petitioner and respondent nos. 2 and 3 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned from Police Station Malviya Nagar, Delhi. 4. Brief facts of the case are that 26.04.2022, M/s Rathi Saria Limited had taken a loan of ₹50,00,000/- from the petitioner at 87% per annum interest. Subsequently, eight cheques of ₹8,06,250/- each were issued for repayment of loan. On 20.05.2022, the company had taken another loan of ₹1,00,00,000/- from M/s Shamsher Enterprises (owned by the petitioner) at 90% per annum interest. It is stated that on 28.09.2022, some part payments were made to the petitioner and fresh loan agreements were executed and new cheques were issued replacing old ones. Further, on 23.03.2023, the petitioner had allegedly visited respondents’ house, created a disturbance, and issued threats. Pursuant to which the present FIR was registered against the petitioner under relevant sections. During pendency of the trial, the parties have now amicably settled their disputes vide Settlement Agreement dated 19.09.2024. 5. On a query made by this Court, respondent nos. 2 and 3 who have been identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. Therefore, they have no objection if the present FIR is quashed. 6. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. This is a digitally signed order.
