Order 13/01/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 160/2025 registered at Police Station Jeenmata, District Sikar for the offences under Sections 115(2), 126(2), 331(6) of BNS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is further contended that there is no substantive evidence available on the record indicating the fact that the petitioner caused dangerous to life injury to the injured. The recovery of weapon at the instance of petitioner was effected after one and a half month and that also from the open field. The petitioner is involved in this case solely on the basis of doubt. The accused-petitioner is in
[2026:RJ-JP:1408] (2 of 3) [CRLMB-16558/2025] custody since 15.10.2025 and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application and contended that the FIR was lodged on the basis of parchabayan of injured in which he has expressed his doubt over the petitioner and petitioner was arrested and from his instance weapon i.e. axe containing blood stains was recovered. There was dispute between petitioner and complainant with regard to some amount. Injuries sustained to injured at his head was found to be dangerous to life and injured was operated twice due to injury sustained at his head, therefore, considering the above facts, his bail application deserves to be dismissed. 4. Heard and perused the material available on record. 5. Considering the fact that the charge-sheet has already been submitted before the concerned court and there is no direct evidence available on record indicating petitioner's presence at the place of occurrence. The recovery of weapon at the instance of petitioner was effected after one month and 12 days. The accused-petitioner is in custody since 15.10.2025 and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rameshwar Lal S/o Shri Kanaram, in connection with FIR No. 160/2025 registered at Police Station Jeenmata, District Sikar shall be
[2026:RJ-JP:1408] (3 of 3) [CRLMB-16558/2025] enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
