JUSTICE LALITHA KANNEGANTI ORAL ORDER The writ petition is filed seeking the following prayer:- a) Issue a writ in the nature of Mandamus or any other appropriate writ, order or direction directing Respondent Nos.2 and 3 to consider the representation submitted by the petitioner vide Annexure-H dated 15.05.2026 objecting the renewal and continuation of the CL-2 licence of "KAVERI WINES CL-2" in the schedule premises; b) Issue a writ, order or direction restraining Respondent Nos.2 and 3 from renewing, extending, approving or permitting continuation of the CL-2 licence standing in the name of the 4th respondent in respect of the schedule premises situated at Sy.No.224, Channasandra Village, Bidarahalli Hobli, Bengaluru East Taluk, without the consent and authorization of the petitioner; - 3 - HC-KAR NC: 2026:KHC:25313 WP No. 15887 of 2026 c) Declare that continuation or renewal of CL-2 licence in favour of the 4th respondent in respect of the petitioner's premises after expiry of lease period and after withdrawal of consent by the petitioner is arbitrary, illegal and contrary to law; d) Pass such other writ, order or direction as this Hon'ble Court deems fit, proper and necessary in the facts and circumstances of the case, in the interest of justice and equity. 2. Learned counsel for the petitioner submits that the lease expired in the year 2024 and the suit filed by the tenant was dismissed with cost. Hence, the respondents can not extend the lease. 3. Learned AGA submits that the license of the respondent is renewed on 01.07.2025 till 30.06.2030. Since the license has already been renewed, if the petitioner has any cause of action, he has to question the license granted to the respondent on 01.06.2025 and nothing survives for consideration in this Writ Petition. 4. Considering the facts that the license is already renew from 01.07.2025 till 30.06.2030 petitioner has to question the renewal order and he can not have any relief in this writ petition. Accordingly, the Writ Petition is disposed of giving liberty to the petitioner to question the proceedings dated 01.07.2025. ii. All I.As. in this petition shall stand closed.
