1. Heard Mr. Prashant Kumar Singh, learned counsel for the appellant and Mr. Azeemuddin, learned counsel for the State.
2. The present criminal appeal has been preferred against the judgment of conviction dated 11.12.2018 and order of sentence dated 15.12.2018, passed in Cyber Crime Case No.02 of 2016, corresponding to Cyber Crime P.S. Case No.02 of 2016 (CNRJHRN 01-001670-2016) by the learned Additional Judicial Commissioner-II, Ranchi, whereby the appellant has been convicted for the offence punishable under Section 66(C) of the Information Technology Act (in short I.T. Act) and has been sentenced to undergo rigorous imprisonment for two years and to pay a fine of Rs.20,000/- (Twenty thousand) and in default thereof, further directed to under go simple imprisonment for four months. - 1 - Cr. 3. At the very outset, learned counsel for the appellant has prayed that benefits of Sections 3/4 of the Probation of Offenders Act, 1958, may be extended to the appellant.
4. A report has been called for regarding the conduct of the appellant from the concerned Probation Officer vide order dated 08.04.2026 and from perusal of the report, it appears that this appellant is otherwise a good boy and is preparing for competitive examination to get a government job and no complaint whatsoever has been made by his neighbours.
5. Considering the above report and the prayer of the appellant, the benefits of Section 4 of the Probation of Offenders Act, 1958 is, hereby, extended to the appellant. The sentence, awarded to the appellant, is suspended for the six months and if any adverse report comes against the appellant within that period, the concerned Probation Officer is
directed to report this Court.
6. With the above benefit of Section 4 of the Probation of Offenders Act, 1958, the present appeal stands disposed of.
7. Let the Trial Court Records be sent back to the Court concerned forthwith, along with a copy of this Judgment.
