CARAP(M)-19 of 2026 By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicants/ appellants for condonation of delay in maintaining the accompanying appeal, which is barred by limitation. Having carefully perused the averments contained in the application, which is duly supported by an affidavit, this Court finds no impediment in accepting the prayer, especially when delay caused in maintaining accompanying appeal does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicants/ appellants, as such, the same deserves to be condoned. In view of above, delay, which has been otherwise sufficiently explained is condoned. The application is disposed of. CARBA No. _________ of 2026 (CARBST/44764/2026) Be registered. Admit. Post admission notice to respondent be issued, returnable for 06.10.2026, on taking steps within one week. In the meanwhile, record of Court below be called for.
