JUSTICE ANANT RAMANATH HEGDE ORDER Sri K.R.Anand, learned counsel undertakes to appear on behalf of the respondent. This petition is filed assailing the award dated 05.02.2020 passed in ID.No.8/2016 on the file of Labour Court, Tumkur. In terms of the said award, the claim petition filed by the workmen was allowed holding that retrenchment of first party workmen from service with effect from 01.01.2016 is not justified. 2. The award also directed that the first party workmen shall be given benefit of continuity of service as if they had worked in the second party from the date of - 3 - HC-KAR NC: 2026:KHC:12864 WP No. 4800 of 2026 refusal of employment i.e., with effect from 01.01.2016. Second party employer is also directed to pay all the consequential monetary benefits to the first party workmen. 3. This award is also questioned by the employer in WP.No.8032/2020. The workmen also appeared in that matter and the aforementioned writ petition is allowed vide order dated 07.11.2025 and award is set aside. 4. It is submitted that the respondents in the said WP.No.8032/2020 who are the petitioners before this Court have filed an appeal in W.A.No.526/2026 against the order dated 07.11.2025. That being the position in the present writ petition challenging the award dated 05.02.2020 in ID.No.8/2016, which is already set aside is not maintainable.
