The present C.M.P. has been filed seeking modification of the order dated 7th April, 2025 passed by this Court in W.P.(C) No.1677 of 2025, as the name of the Mouza/Village has been erroneously mentioned as "Jori" in paragraph no.1 of the said order, whereas the correct name of the Mouza/Village is "Karmali". 2. A counter affidavit on behalf of the Opposite Party Nos.5 to 8 has been filed on 20th January, 2026, paragraph no.14 of which reads as under: - ”14. That it is most humbly stated and submitted that the petitioner has no bona fide intention for modification and reason for modification is not supported with relevant document or evidence.” 3. On perusal of the record, it appears that, even prior to the filing of the counter affidavit, the petitioner had filed a 2026:JHHC: 21205 2 supplementary affidavit on 11th December, 2025, after serving a copy of the same upon the learned State counsel. 4. A copy of an affidavit dated 4th June, 2010 has been annexed as Annexure-SA-1 to the said supplementary affidavit which suggests that the land in question was earlier donated by the petitioner to the State Government for the construction of a Health Sub-Centre. As per the recital of the land made in the affidavit dated 4th June, 2010, the village/mouza of the land in question is “Karmali”. A copy of affidavit dated 4th June, 2010 was also annexed with writ petition being W.P.(C) No.1677 of 2025. 5. On the basis of the particulars mentioned in the said affidavit, the petitioner has prayed for correction of the name of mouza in the order dated 7th April, 2025 passed in W.P.(C) No.1677 of 2025 as “Karmali” instead of “Jori”. 6. According to the learned counsel for the petitioner, the name of the Mouza of the land was erroneously mentioned in the writ petition as "Jori" instead of "Karmali", and due to the said error in the writ petition, the Mouza of the land was also mentioned as "Jori" in the order dated 7th April, 2025. 7. Considering the fact that the Mouza of the land in question was inadvertently mentioned as "Jori" in the writ petition and that the affidavit dated 4th June, 2010 executed by the petitioner donating the said land to the State Government for the construction of a Health Sub-Centre, describes the village/Mouza of the land as "Karmali", this Court is of the view that the name of the Mouza of the land in question mentioned 2026:JHHC: 21205 3 as "Jori" in the order dated 7th April, 2025 deserves to be corrected to "Karmali". 8. 8. Accordingly, in the fourth line of paragraph no.1 of the order dated 7th April, 2025 passed in W.P.(C) No.1677 of 2025, name of the Mouza of the land mentioned as “Jori”, be corrected and read as “Karmali”. 9. The order dated 7th April, 2025 passed in W.P.(C) No.1677 of 2025 is modified to the said extent. 10. The present C.M.P. is disposed of.
