Jiya Lal Bhardwaj , Judge (Oral) Learned vice counsel representing the respondents has produced a copy of office order dated 05.05.2026, passed by the Director (Central Zone) HPSFDCL, Mandi, which is taken on record. 2. A perusal of the aforesaid office order reveals that the petitioner has been granted the work charge status w.e.f. 01.01.1997 on completion of 8 years of daily wage service with a minimum 240 days in each calendar year on notional basis, but without granting annual increments. It has also been observed that the matter was referred to the Government of Himachal Pradesh for further instructions, 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 regarding grant of notional annual increment during work charged service. The Government of Himachal Pradesh has intimated vide letters dated 13.02.2026 and 04.04.2026, that the period of work charge service shall not be counted for seniority, increments, pay fixation, pension or other similar service related benefits. 3. Learned vice counsel for the petitioner submits that the instructions dated 04.04.2026, issued by the State Government have been stayed by the Hon’ble Division Bench of this Court in CWP No.8410 of 2026, titled, Umesh Larzoo vs. State of H.P. & Ors. 4. Keeping in view the aforementioned facts, the learned vice counsel for the petitioner submits that he may be permitted to withdraw the present petition at this stage, however, liberty may be reserved to approach this Court afresh after the decision in CWP No.8410 of 2026 or any other decision taken by the Hon’ble Division Bench while adjudicating the instructions dated 04.04.2026. 5. In view of the above, the petition is dismissed as withdrawn, with liberty as prayed for.
