This CRLMP has been filed for a direction to the Opposite Party No.3 to investigate the matter and add Opposite Party No.4 as accused No.2. 2. The second portion of the order to add Opposite Party No.4 is misconceived as it is the prerogative of the Investigating Officer(in short, “I.O”) to carry out investigation and proceed against an accused if the investigation reveals incriminating materials against him. During pendency of the investigation, this Court cannot direct any I.O to add any person as an accused in the case. 4. Mr. Mishra, learned counsel for the Petitioner submits that the Petitioner had earlier filed CRLMP No. 507 of 2025, where this Court by order dated 03.05.2025 had directed that since FIR had already been registered in Kabi Suryanagar PS Case No. 88 of 2023, the concerned I.O should proceed with the investigation in a free and transparent manner for reaching its logical end. But more than one year has elapsed in the meanwhile but investigation is still pending. 5. The CRLMP is therefore disposed of directing the Opposite Party No.2- the IIC of Kabi Suryanagar Police Station to complete the investigation in this case expeditiously in accordance with law.
