By the present petition, the petitioners have challenged the order dated 15/11/2016 issued by the Respondent No.1/CERC (ANNEXURE-P/1) directing for initiating action under Section 142 of the Indian Electricity Act, 2003. The Petitioners also challenge the complaint filed by the Respondent No.2/ BALCO before the Respondent No.1/CERC. The Petitioner further challenge the order dated 30/10/2014 (ANNEXURE-P/3) issued by the Respondent No. 1/CERC who has directed the petitioner to settle the dues of the Respondent no.2/ BALCO. 2. Learned counsel for the respondent No.2, by referring Annexure P-14 of the writ petition, submits that initially the petitioners have questioned the order of respondent No.1 before the appellate Tribunal for Electricity at New Delhi i.e. 3 DFR No.3156/2014, however, the same was withdrawn without seeking a liberty from the said Tribunal. Hence, the present writ petition is not maintainable as the petitioner has withdrawn the appeal from the Tribunal and there is no order on merits by the learned appellate Tribunal. 3. Learned counsel for the petitioners submits that though the appeal was preferred and withdrawn, no liberty was sought at that time to approach the appropriate authority, therefore, he seeks permission to withdraw the present petition with liberty to approach the appropriate forum as may be available to him under the provisions of law. 4.
