GINJUPALLI SUBBA RAO The Court made the following COMMON JUDGMENT: The grievance of the petitioner in W.P.No.22504 of 2022 is that the respondents are constructing Village Secretariat, Health center & Rythu Barosa Kendram in the land covered by Sy.No.137/1B1B of Bathulavarigudem, Nuzvid Mandal, Eluru District. 2. Impugning the resolution No.69/A dated 20.06.2020 issued by the 4th respondent-Gram Panchayat, wherein Ac.0.10 cents, Ac.0.04 cents & Ac.0.04 cents in R.S.No.137/1B2 of Bathulavarigudem Gram Panchayat was allotted for construction of Village Secretariat, Health center & Rythu Barosa Kendram, the W.P.No.12199 of 2023 was filed. 3. The petitioner in both the writ petitions is one and same and since both the writ petitions are interlinked, they are heard together and are being disposed of by this common judgment. 4. Sri Y.Koteswara Rao, learned Standing counsel for Gram Panchayat on instructions of Chief Executive officer, Zilla Praja Parishad, West Godavari District dated 31.12.2025 at Para No.4 submitted that, pursuant to the interim directions passed by this Hon’ble Court on 26.07.2022, the proposed construction of three Government buildings (Village Secretariat, Health center & Rythu Barosa Kendram) in Sy.No.137/1B of Bathulavarigudem was stopped, notwithstanding the fact that the said buildings were proposed to be constructed in R.S.No.137/1B vide Gram Panchayat Resolution No.69A, however, there is no proposal for construction of the said buildings as on date. As such prayed to pass appropriate orders in that regard. 5. In view of the above submissions that there is no proposal for construction of the said buildings as on date, there remains nothing for adjudication and both the writ petitions are liable to be closed. Accordingly, both the writ petitions W.P.No.22504 of 2022 & W.P.No.12199 of 2023 are closed. It is needless to observe that if at all the respondent authorities have an intention to construct the said government buildings, they have to follow the procedure established under law. No costs.
