Instant writ petition under Article 226 / 227 of the Constitution of India has been preferred by the petitioners seeking following reliefs :- “10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records in relation to the case of the petitioner from the possession of respondents for its kind perusal. 10.2 That, this Hon’ble Court may kindly be pleased to issue a writ or writs/order or orders quashing impugned order dated 25.09.2023 (Annexure P/1) being arbitrary, illegal and against the law. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to take proper course of action against the respondent No. 6. 10.4 That, this Hon’ble Court may kindly be pleased to hold that the petitioner’s appointments have been made in accordance with law. 10.5 That, this Hon’ble Court may kindly be pleased to grant any other relief/relief’s in favour of the petitioner, which the Hon’ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner. 3 2. Learned counsel appearing for the petitioners submits that respondent No. 6/ Lakhanlal Dewangan had lodged a complaint assailing the petitioner’s appointment. Based on that complaint, vide order dated 25.09.2023 (Annexure P-1), Chief Medical & Health Officer, District Janjgir-Champa has constituted team of doctors to enquire the complaint filed by respondent No. 5. Aggrieved thereby, the petitioners have preferred the instant petition contending that respondent No. 6, has no locus standi or legal authority to challenge the petitioners’ appointment. It is therefore prayed that this petition may be allowed. 3. Per contra, learned counsel for respondents No. 1 to 5/State submits that the complaint filed by respondent No. 6 was thoroughly investigated by team of doctors and upon enquiry, the allegations were found to be unsubstantiated vide Enquiry Report Anneuxre R1-5/2. Consequently, the matter has been closed. 4. I have heard learned counsel for the parties, gone through the pleadings and documents annexed with the writ petition. 5. From the perusal of reply filed by the State and document Anneuxre R1-5/2 show that the matter has been enquired by the team of doctors, thereafter, enquiry report was submitted vide Enquiry Report Anneuxre R1-5/2 by the said team of doctors stating therein that the complaint is found to be false. This fact is further corroborated by the inquiry report submitted by the State on 05.02.2024 (Annexure R1-5/2), which was filed before the Collector, Janjgir-Champa, on 07.02.2024. 6. Thus. since enquiry has already been conducted and on enquiry report, it has been found that complaint filed by respondent No. 6 – Lakhan Lal Dewangan is false, therefore, this petition has become infructuous, as the enquiry has already been concluded and the same has been reported in favour of petitioners herein. 7. In view of above, this petition stands disposed of as having become infructuous.
