The petitioners have been made accused in connection with Bengabad P.S. Case No.123 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 117(2), 118(2), 109(1), 324(2), 304(2), 351(1), 352, 3(5) of the B.N.S., 2023. Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners, in furtherance of common intention with the co-accused persons, attempted to murder the informant, his nephew and Yogendra Prasad Verma by assaulting them with rod, sabbal (crowbar), lathi and tangi (axe) and by putting soil into his mouth in order to kill and committed theft of Rs.20,000/-, gas stove, utensils as well as mobile phone. It is next submitted that the allegation against the petitioners is false, and general and omnibus in nature. It is then submitted that the genesis of the occurrence is land dispute. It is further submitted that the petitioners have been in custody since 05.06.2026 as mentioned in para-1 of the instant bail application. It is next submitted that the petitioners have no criminal antecedent as mentioned in para-12 of the instant bail application. It is also submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 14th July, 2026 passed in B.A. No.6542 of 2026. It is lastly submitted that the petitioners undertake to co-operate with the trial of the case and also undertake not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioners be released on bail. Learned counsel appearing for the State opposes the prayer for bail of the petitioners. Considering the facts of this case, the above-named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Giridih in connection with Bengabad P.S. Case No.123 of 2025 with the condition that they will co-operate with the trial of the case and furnish their mobile numbers and photocopy of the Aadhar Cards in the court below with an undertaking that they will not change their mobile numbers during the trial of the case and they will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
