Mr. Subrata Bhattacharya …for the Petitioner The petitioner herein is the wife, who filed an execution proceeding being Misc. Execution Case No. 104 of 2021 arising out of Misc. Case No. 238 of 2020 for realization of arrear maintenance allowance from the opposite party no. 2/husband herein. The said execution case is still pending and the petitioner/wife has not received the maintenance amount as passed by the learned Magistrate. The petitioner/wife herein has prayed for a direction upon the court below for expeditious disposal of the aforesaid Misc Execution Case No. 104 of 2021. Having considered that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with. Considering the fact that the execution case is pending for more than five years and the petitioner who is a hapless lady is running from pillar to post for release of the maintenance amount, I find that the prayer made by the 2 petitioner is justified and is required to be allowed for securing the ends of justice. In view of the above, the instant application being CRR 4704 of 2025 is hereby disposed of with a direction upon the court below for expeditious disposal of the Misc. Execution Case No. 104 of 2021 arising out of Misc. Case No. 238 of 2020 and to make its best endeavour to conclude the execution proceeding preferably within a period of three months from the next date of hearing.
