The petitioner has been made accused in connection with N.D.P.S. Case No.09 of 2022 arising out of Godda (Town) P.S. Case No.263 of 2022 registered for the offences punishable under Section 20 (b), 21 (b) and 22 (b) of the N.D.P.S. Act. This is the third journey of the petitioner with the self-same prayer for regular bail as earlier the prayer for bail of the petitioner was rejected on merit twice out of which the last one was vide order dated 12.01.2024 passed in B.A. No.10211 of 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in purchase and sale of Brown Sugar and 3.5gm of Ganja which comes under small quantity and 1.01 gm of Brown Sugar was recovered from his possession. It is submitted that the allegation against the petitioner is false. It is next submitted that the fresh ground is that after rejection of the prayer for bail of the petitioner, three witnesses have been examined out of which P.W.2 has been declared hostile. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 01.10.2022 as has been mentioned in para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Spl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Godda in connection with N.D.P.S. Case No.09 of 2022 arising out of Godda (Town) P.S. Case No.263 of 2022 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
