Himanshu Sharma vs. M/s Mohit Saklani Traders
Cr.Revision No.204 of 2026
04.08.2026 Present: Ms. Anubhuti Sharma, Advocate for the
petitioner.
Mr. R.K. Sharma, Senior Advocate with Mr. Arun Kumar, Advocate for the respondent.
Cr.M.P. No.3235 of 2026
The applicant/petitioner by way of present application filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (in short ‘BNSS’) has prayed for extention of time to deposit 30% of the compensation amount as directed by this Court vide order dated
10.04.2026.
2.
It has been averred in the application that the applicant/petitioner is a poor person of modest means and is presently facing acute financial hardship on account of prolonged litigation spanning several years. Further, it has been averred that he is making all possible efforts to arrange the said amount and undertakes to deposit the same at the earliest.
3.
This Court while disposing of the application for suspension of sentence had granted eight weeks time to deposit 30% of the compensation amount, keeping in view the fact that amount to be deposited by the applicant was
out of the total compensation amount of Rs.10,30,000/-. The period of eight weeks had expired on 05.07.2026. The applicant/petitioner has filed the present application on 25.07.2026 and sought eight weeks time to deposit 30% of the compensation amount.
4.
Keeping in view the fact that eight weeks time had expired on 05.07.2026, only four weeks further time is granted to the applicant/petitioner to deposit 30% of the compensation amount from today.
5.
Consequently, the present application is allowed and the applicant/petitioner is granted four weeks further time to deposit 30% of the compensation amount, in terms of order dated 10.04.2026 from today. However, it is made clear that this is the last opportunity granted to the applicant/petitioner to deposit 30% of the compensation amount.
6.
The application stands disposed of.
