Apprehending arrest, the applicants have approached this Court in connection with Crime No.283/2026 for the offences punishable under Sections 316(2), 318(4), 336(2), 338, 339 and 61(2) of Bharatiya Nyaya Sanhita, 2023, registered with Police Station Beltarodi, District Nagpur. 3. The First Information Report shows that there is a dispute relating to the management and affairs of M/s. DVS Mining Infra Private Limited. The allegations pertain to the constitution of the Board of Directors, shareholding, resignation of Directors, operation of the company and its bank accounts, and accounting of company funds. 2 16-Cr.ABA-648-2026 signature of one of the Directors – Pranjali was forged on her resignation letter, pursuant to which she was shown to have resigned and her father was inducted in her place. It is further alleged that an amount of Rs.80,00,000/- of the company was diverted to a personal account. 4. The learned counsel for the applicants submits that the allegations against the applicants are that they have forged the signature of one of the Directors of the company on the resignation letter, and accordingly, she was expelled from the company, and instead of Pranjali, her father was inducted into the company. The amount belonging to the company was deposited in the personal account of the applicants by way of misappropriation the company sustained losses. However, he submits that the amount which was shown as the misappropriated amount was used for the day-to-day expenses of the company, and not a single rupee has been spent for personal use. The allegations, even if taken as they are, are of a civil nature and have been converted into a criminal case. Under such circumstances, he submits that the applicants be granted anticipatory bail. 5. On the other hand, the learned A.P.P. vehemently opposes the application and submits that, apparently, the signature of Pranjali has been forged by the applicants on the resignation letter, and it was shown as if the said Pranjali had Piyush Mahajan
3 16-Cr.ABA-648-2026 tendered her resignation. The amount of the company was diverted to a personal account to the tune of Rs.80,00,000/-. The custodial interrogation would be necessary to ascertain the money trail of the misappropriated amount. Under such circumstances, she prayed for rejection of the application. 6. I have considered the rival submissions.
It appears that this Court has granted interim protection to the applicants, and accordingly, the applicants have attended the Police Station several times and also cooperated in the investigation. It appears that it is a dispute among the directors of the company. Though, it is alleged that Rs.80,00,000/- has been diverted to a personal account, however, considering the fact that it is a dispute among the directors of the company, I am of the considered opinion that the interim order granted by this Court by order dated 23/07/2026 needs to be confirmed. Hence, the following order:- . O R D E R (i) The Criminal Application is allowed and
disposed of; (ii) The order dated 23/07/2026 is hereby confirmed on the same terms and conditions as incorporated in the said order; (iii) Pending Misc. Application(s), if any, also stand

4 16-Cr.ABA-648-2026 (iv) The observations of this Court are prima facie in nature and are only limited to this application. The trial Court shall not be influenced by the aforesaid observations.
