Learned advocate appearing for the petitioner submits that petitioner is driver of a truck which was carrying ganja to the tune of 90 kgs. According to the learned advocate for the petitioner that the is in custody for more than one year five months and till date 7 witnesses have been examined out of the cited 12 witnesses. Mr. Sagar Saha, learned advocate is directed to represent the State. His appearance may be regularized by the concerned authority. Learned advocate for the State opposes the prayer for bail and submits that the present petitioner was well aware regarding the availability of the contraband and is thickly connected with the offence. Having considered the same and the fact that the provision of Section 37 of the NDPS Act is attracted, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 793 of 2026 is dismissed. 2 Memo of evidence submitted by the State be kept with the record.
