Order No.02 Dated- 17-07-2026
Heard the parties. The petitioner has moved this Court for grant of bail in connection with Chainpur P.S. Case No. 16 of 2021 arising out of S.T. Case No. 304 of 2021 corresponding to G.R. No. 686 of 2021 registered for the offences punishable under Sections 302/34 of the I.P.C. This is the second journey of the petitioner with the prayer for regular bail, as the earlier bail application of the petitioner was rejected on merits by the co-ordinate Bench of this Court vide order dated 06.03.2025 in B.A. No. 1833 of 2025. The learned counsel for the petitioner submits that the only fresh ground is that petitioner has been in custody for some more time and none of the witnesses have been examined. It is next submitted by the learned counsel for the petitioner drawing attention of the Court to the order dated 04.05.2026 passed in Sahil Manoj Machare versus The State of Maharashtra in Special leave to Appeal (Crl.) No. 7502 of 2026 wherein the Hon’ble Supreme Court of India in the facts of that case, where charges were framed in the year 2024 and the appellant was in custody since 01.11.2022, observed that if the right of speedy trial is infringe then Court must
consider the plea for bail appropriately. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl.P.P. on the other hand vehemently opposes the prayer for bail of the petitioner and submits that keeping in view the serious nature of offence as well as the prayer for regular bail of the petitioner was earlier rejected on merit, there is every chance of the petitioner absconding and tampering with evidence, if released on bail. It is therefore, submitted that the petitioner ought not be released on bail. Considering the serious nature of allegation against the petitioner of committing murder of Nabil Khan and the prayer for regular bail of the petitioner has already been rejected on merit, this Court is not inclined to admit the petitioner on bail merely on the ground that the petitioner has been custody for some more time. Accordingly, the prayer for bail of the above-named petitioner is rejected.
