The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.282/2025, registered at Police Station – Khursipar, District- Durg (C.G.) for the offences punishable under Sections 8, 22(C), 27(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act and 111(3) of Bharatiya Nyaya Sanhita, 2023(BNS). 2. As per the prosecution case, in brief, on 03.10.2025, Sub-Inspector Motilal Mahilwar of Police Station Khursipar received secret information from an informer that certain unknown persons were involved in the illegal sale of narcotic substances. Acting upon the said information, the police PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.12 12:06:07 +0530 2 officer, along with the accompanying staff and independent witnesses, proceeded to the spot, surrounded the area, and apprehended the present applicant along with other co-accused persons. Upon search of the accused persons, the following contraband substances were allegedly recovered from their possession: from accused Arbaz Khan, 700 tablets of Alprazolam 0.5; from accused Rajneesh Pandey, 192 tablets of Prosygco Spas; from accused Vipin Gems @ Chotu, 312 tablets of Prosygco Spas; from accused Shyam Kanhaiya Vishwakarma, 264 tablets of Prosygco Spas Tramadol; from accused Ranjeet Ram, 280 tablets of Prosygco Spas Tramadol; and from Abhijeet Kumar Sahu, 296 tablets of Prosygco Spas Tramadol were allegedly seized. On the basis of the aforesaid allegations, Crime No. 282/2025 was registered at Police Station Khursipar, District Durg, for offences punishable under Sections 8, 22(C), and 27(A) of the NDPS Act. The applicant was arrested on 03.10.2025, and after completion of the investigation, the charge-sheet has been filed before the competent Court. Hence, the present bail application. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that nothing has been recovered from the exclusive possession of the present applicant. Further, the charge-sheet has been filed and the applicant has no previous criminal antecedents. He also submits that the applicant is in jail since 03.10.2025. The conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the charge-sheet has been filed. She further submits that from the possession of the applicant/accused, a total of 700 tablets of the narcotic substance Alprazo 0.5 (Alprazolam) were seized, 3 which is much above the commercial quantity. Hence, his bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that from the possession of the applicant/accused, a total of 700 tablets of the narcotic substance Alprazo 0.5 (Alprazolam) were seized, which is much above the commercial quantity and the applicant has failed to give any explanation for the same and it cannot be said to be a case of false implication, further the charge-sheet has been submitted and the trial is in progress, hence, this Court is of the opinion that it is not a fit case to release the applicant on bail. 7. Accordingly, the bail application of applicant – Arbaz Khan Urf Babbu, involved in Crime No.282/2025, registered at Police Station - Khursipar, District- Durg (C.G.) for the offences punishable under Sections 8, 22(C), 27(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act and 111(3) of Bharatiya Nyaya Sanhita, 2023(BNS), is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
