The petitioner who is the Pradhan of Sripur-II Gram Panchayat seeks consideration of the complaint lodged by him against one of the members of the Panchayat being the private respondent herein, seeking her removal under Section 11(1)(d) of the West Bengal Panchayat Act on the ground of her absence in three consecutive Panchayat meetings. Opposing such allegation, learned counsel for the private respondent submits that in paragraph 7 of the writ petition, the petitioner has alleged that on February 02, 2026 one meeting was held at the Panchayat premises and the private respondent along with eight other members of the Panchayat and local goons entered the meeting place, attacked the petitioner and the other members of the Panchayat and snatched away the resolution book. They put their signatures on several pages of the book to endorse their attendance in the earlier meetings forcibly. In the complaint lodged by the petitioner on February 07, 2026, it is stated that subsequent to the meeting held, the private respondent and others entered the Panchayat office on February 02, 2026 when he was not present in the office. The complaint dated February 09, 2026 records that on February 02, 2206 after completion of the Gram Panchayat meeting the private respondent and other members entered the office in his absence. Learned counsel points out that the two complaints are contradictory to each other as well as the averment made in the writ petition. At this stage learned counsel for the petitioner seeks to withdraw the writ petition and file a fresh writ petition on the same cause of action. Such prayer is allowed. The petitioner is permitted to withdraw the writ petition and file afresh on the same cause of action. The writ petition is accordingly dismissed as withdrawn.
