Anantpura, Kota City. Presently At House No. 20, Morya Nagar, P.S. R.K Puram, Kota. (At Present Confined in District Jail Kota). ----Petitioner Versus State of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Devanshu Sharma For Respondent(s) : Ms. Arti Sharma, PP Mr. Om Prakash Pareek HON'BLE MR. JUSTICE SANDEEP TANEJA Order 05/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.211/2025 registered at Police Station R. K. Puram, District Kota City for offence(s) under Section(s) 420, 406 and 120-B IPC. 2. Learned counsel for the petitioner submits that the accused-petitioner is an innocent person and has been falsely implicated in this case. Learned counsel further submits that petitioner has no nexus with the alleged offence and was merely a witness to the alleged agreement and power of attorney. Learned counsel also submits that the alleged offences are triable by Magistrate. He further submits that the petitioner is in custody since long, charge-sheet has already been filed in the matter and [2026:RJ-JP:5418] (2 of 2) [CRLMB-16729/2025] no recovery is required to be made from the petitioner, so no fruitful purpose would be served by keeping the petitioner in custody, hence, petitioner may be enlarged on bail. 3. Per contra, learned Public Prosecutor and learned counsel for the complainant oppose the bail application and submit that there are nine criminal antecedents against the petitioner. 4. In respect to criminal antecedents, learned counsel for the petitioner submits that out of those nine criminal antecedents, negative final report has already been submitted in seven cases. 5. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that charge-sheet has been filed and offences are triable by Magistrate, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Therefore, this bail application is allowed and accused-petitioner Krishan Murari S/o Ramgopal is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
