Manoj vs State of H.P. Cr.MP No. 1592 of 2026 24.08.2026 Present: Mr. Rohit, Advocate for the petitioner. Mr. Jitender Sharma, Additional Advocate General for the respondent/State. The present application has been filed for seeking condonation of a delay of 352 days’ in filing the appeal. It has been asserted that the applicant is a poor person. He was taken into custody after the pronouncement of the judgment. He was not in a position to engage a private counsel to challenge this conviction and order of sentence. He applied for Legal Aid services which were provided to him which led to the delay. Hence, the application. No reply to the application has been filed. Heard. The averments in the application that the applicant is in custody is supported by the Power of Attorney which is signed by the Superintendent of M.C. Jail Kanda, District Shimla. Further the averment that the applicant was provided legal aid is duly supported by the letter of the Secretary HP High Court Legal Services Committee, Shimla for providing legal aid counsel. Since the person cannot be deprived of his liberty because of his poverty, therefore the present application is allowed and the delay in filing the appeal is ordered to be condoned.
The present application stands disposed of.
Cr. A (C-SB) (ST) No. 7104 of 2026 Vide separate order passed in Cr.MP(M) No. 1592 of 2026 the delay in filing the appeal is condoned, it be registered. Mr. Jitender Sharma, Additional Advocate General appears and waives service of notice on behalf of the respondent/State. Copy of appeal be supplied to the learned Additional Advocate General for the respondent/State. Record be also requisitioned.
