Smt.B.V.Vidyulatha, counsel for respondent No.1, appeared through video conferencing. 2. This petition is filed seeking the following reliefs: a. Issue a Writ of Certiorari or any other writ or order, quashing the communication bearing No. KN/PF/IRO/Mys/PoHW/2025-26/02 dated 01.04.2026 passed by 1st Respondent (placed as Annexure - M) as the same is illegal, unfair and unconstitutional. - 3 - HC-KAR NC: 2026:KHC:27981 WP No. 13207 of 2026 b. Order that the members of the Petitioners (as per Annexure - A) are eligible for higher pension on higher wages as on 31.10.2025, as per the provisions of EPS 95 c. A Writ of Mandamus or any other writ or order, directing the 1st Respondent to approve the Application of the members of the Petitioners (as per Annexure - A) who have opted for higher pension on higher wages and consequently provide them the higher pension on higher wages with arrears; d. Such other writ, direction or order as this Hon'ble Court may deem just and expedient in the circumstances of the case, including award of costs. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the papers with utmost care. 4. The issue at hand is confined to a narrow scope, namely, the submission of joint declaration forms seeking a higher pension. On behalf of respondent No.2–Management, it is submitted that due to network difficulties, the uploading of employee data could not be completed within the stipulated time. Consequently, the Management requested respondent No.1–Organization to reopen the portal for submission of the requisite particulars. This request, however, was rejected on 01.04.2026. - 4 - HC-KAR NC: 2026:KHC:27981 WP No. 13207 of 2026 In view of the technical impediment that prevented the timely uploading of the data, a direction is hereby issued to respondent No.1 to reopen the portal, enabling the submission of employee particulars. Respondent No.2–Management shall, upon receipt of a certified copy of this order, submit the employee data within two weeks. Thereafter, respondent No.1 shall consider the joint declaration forms in accordance with the law within six weeks. 5. With the above observations, the writ petition is disposed of.
