( Accused At Present Confined In District Jail Baran) ----Petitioners Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Anubodh Jain For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 19/01/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.163/2023 registered at Police Station Kotwali Baran, District Baran for the offence(s) under Sections 306 read with Section 34 of IPC.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the other similarly placed co-accused Dwarka Bai has already been enlarged on bail by the co-ordinate Bench vide order dated 01.12.2025. There is no evidence that soon before the death of deceased, she was subjected to cruelty by the
[2026:RJ-JP:2089] (2 of 3) [CRLMB-16772/2025] petitioners or that deceased was instigated to commit suicide. There are no criminal antecedents against the petitioners. It is further contended that the petitioners are in custody since 08.11.2025 and charge-sheet has already been submitted before the concerned Court, the trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the deceased suicidal note categorically stated that the petitioners used to harass her continuously after the death of her husband and also used to beat her, therefore, considering the allegations stated in the suicide note, the bail application of the accused-petitioners may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case. Considering the period of long incarceration of the petitioners and the fact that charge-sheet has already been submitted before the concerned Court and other similarly placed co-accused Dwarka Bai has already been enlarged on bail, therefore, I deem it just and proper to enlarge the accused- petitioners on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely:
1. Manbhar Bai Wife Of Hemraj and 2. Shivani Daughter Of Hemraj, in connection with FIR No.163/2023 registered at Police Station Kotwali Baran, District Baran, shall be enlarged on bail
[2026:RJ-JP:2089] (3 of 3) [CRLMB-16772/2025] provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
