JUSTICE P SREE SUDHA ORAL JUDGMENT This appeal is filed by the appellant/owner of the vehicle under Section 173(1) of Motor Vehicles Act, 1988 challenging the judgment and award dated 12.07.2013 passed in MVC No.12/2011 on the file of the III Additional District and Sessions Judge and MACT, Bangalore Rural District, Sit at Anekal. 2. Heard the arguments of learned counsel for the both sides. 3. This appeal is filed by the owner of the vehicle and he filed I.A.No.2/2014 for permission to produce the following additional documents: 1. Copy of the delivery note. 2. Copy of the Indemnity Bond. 3. Copy of the charge sheet. 4. Copy of the B register. - 4 - HC-KAR NC: 2026:KHC:27851 MFA No. 616 of 2014 4. Though the appellant had filed a vakalat before the Tribunal, he neither contested the matter nor filed a written statement. The liability has been fastened upon him. He has now come up with the aforesaid documents. 5. Learned counsel for the appellant stated that all the relevant documents are furnished to the earlier counsel before the Tribunal. But the said counsel failed to produce the documents and the appellant had no knowledge of the proceedings. Therefore, this Court finds it just and reasonable to receive the additional documents and remand the matter to the Tribunal. 6. The Tribunal is directed to grant reasonable opportunity to both parties to adduce evidence and arguments and to dispose of the matter on merits, after duly considering the entire evidence on record, within two months from the date of receipt of a copy of this order, as the matter is pertains to the year 2014. - 5 - HC-KAR NC: 2026:KHC:27851 MFA No. 616 of 2014 Learned counsel for both sides are directed to cooperate with the Tribunal for disposal of the case within the stipulated period.
