JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this Court seeking for the following reliefs: - 3 - HC-KAR NC: 2026:KHC:27924 WP No. 15010 of 2025 a. Grant an order, direction or writ in the nature of Certiorari quashing the entire proceedings in MSR CR No.70/2025 pending on the file of Assistant Commissioner Court, Bangalore, before the Respondent No.3 initiated as against the petitioner based on the petition filed by the Respondent No.1 & 2 under Section 7, 22, 23 and 24 of the maintenance and welfare of parents and senior citizens act 2007, and the notice issued by the Respondent No.3 which produced at Annexure-A. b. Grant such other relief or reliefs as this Hon'ble Court may deem fit to grant, including cost of the Petitioners, in the facts and circumstances of the case, in the interest of justice and equity. 2. A memo for withdrawal dated 21.04.2026 has been filed signed by the petitioner and the counsel for the petitioner, which reads as under: "Petitioner is challenging the proceedings bearing No.MSR CR 70/2025 filed before the Assistant Commissione by the Respondent No.1 and 2. During the pendency of the above matter due to intervention of elders and well-wisher the matter has been resolved in the terms of settlement . Accordingly joint memo has been filed in MFA No.6217/2025 and the same was accepted by this Hon'ble Court and in further compromise petition was filed before trail court in O.S.No.2055/2025 and in the terms of compromise the trial court has passed judgment and decree dated 05.01.2026. It is further submitted that in view of the above said settlement the respondent No.1 and 2 herein has withdrawn the petition No.MSR CR 70/2025 filed before the assistant commissioner. So in the above said facts and circumstances this petition become infructuous and it may be permitted to withdraw and dispose of in the terms of settlement in the interest of justice and equity.
