This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant, who is apprehending her arrest in connection SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.05.11 10:34:35 +0530 2 with Crime No.61/2026 registered at Police Station – Sarangarh District - Sarangarh- Bilaigarh, (C.G.) for the offence punishable under Sections 4, 5 and 10 of the CG Agricultural Cattle Preservation Act, 2004. 2. Briefly stated, case of the prosecution is that the concerned police authorities received information from an informant that on the date of the incident, the present Applicant and other co-accused persons were in possession of illegal animal skin and acting upon the said information, the police seized 20 kg of raw cow meat from the present Applicant. Based on the aforesaid allegations, the offences as mentioned above have been registered against the present Applicant. Hence, this application. 3. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that no material has been seized from the possession of the present Applicant and co-accused Janaki has already been granted anticipatory bail by this Court vide order dated 08.04.2026 passed in M.Cr.C(A) No.509/2026. Lastly, it is submitted that trial is likely to take considerable time for its conclusion, therefore, as the present Applicant is similarly situated, she may also be extended the benefit of anticipatory bail. 3 4. Learned counsel for the State, opposed the prayer for anticipatory bail and submitted that the present Applicant is having two criminal antecedents pertaining to Excise Act, therefore, her application for anticipatory bail may be rejected. 5. Having heard learned Counsel for the parties, having considered the facts and circumstances of the case and that co-accused Janaki has already been granted anticipatory bail by this Court vide order dated 08.04.2026 passed in M.Cr.C(A) No.509/2026, the Applicant is a lady and the trial may take quite some time for its conclusion, this Court is inclined to allow the anticipatory bail application. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Sukhbai Miri, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her/him/them from disclosing such fact to the Court. (b) The applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant/s shall appear before the trial Court on each and every date given to her/him/them by the said Court till disposal of the trial. 4 (d) The applicant/s and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
