GP FOR REVENUE 3 CMR,J & GTK,J W.A.No.595 of 2026 The Court made the following: JUDGMENT: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) This intra Court appeal under Clause 15 of Letters Patent is preferred against the docket order of the learned Single Judge, dated 10.04.2026, passed in writ petition No.9655 of 2026, whereby, he has directed to post the matter on 24.04.2026 on the request made by learned Assistant Government Pleader for Revenue, seeking time to get instructions in the matter. 2. Heard learned counsel for the appellant and learned Assistant Government Pleader for Revenue appearing for the respondents. 3. By the impugned order, the learned Single Judge did not decide anything on the merits of the interlocutory application. The grievance of the writ petitioner is that the learned Single Judge did not pass any interim order, as sought for and adjourned the matter, for instructions of the learned Assistant Government Pleader for Revenue. When the learned Single Judge did not decide anything on merits and did not pass any adverse order against the appellant herein in the interlocutory application filed by him, we are of the considered view that the writ appeal cannot be entertained and it is not maintainable. If the appellant got any urgency to obtain interim orders, he can as well make a request before the learned Single Judge to pass appropriate orders, according to law, after the learned Assistant Government Pleader seek instructions, as ordered by the learned Single Judge. 4. Therefore, the Writ Appeal is dismissed as not maintainable. However, the appellant is at liberty to urge before the learned Single Judge for expeditious disposal of his interlocutory application, passing an appropriate order in the interlocutory application filed by him.
