3. The prosecution case is that petitioner No.1 is the husband and other petitioners are the in-laws of the victim. Petitioner No.1 and the victim got married to each other on 13.07.2016. After the marriage, she went to cohabit with the family of the petitioners. 4. It is alleged that, after the marriage, the petitioners started harassing the victim on the ground that her parents had not provided the gift articles, gold and silver ornaments and, a car allegedly demanded by them at the time of the marriage. Petitioner No. 1 snatched the victim’s mobile phone, passbook, and ATM card. Furthermore, it is alleged that the petitioners compelled the victim to leave her job on the false pretext that petitioner No.1 was going to the USA. Therefore, the aforesaid crime came to be registered and it led to filing of chargesheet. 5. The learned Counsel for the parties state that, now, the parties have settled the dispute amicably. The victim has given her consent and no objection to quashing and setting aside the impugned FIR and criminal proceedings arising therefrom. An Affidavit sworn by the victim to that effect is tendered by Mr.Qazi It is taken on record and marked “X”. Both the parties have executed MOU which is attached with the petition. 6. The victim is present before the Court.
She is identified by her learned Advocate. The victim has reiterated the contents of the affidavit. Both the parties have taken a firm stand to put all issues behind and reunite as a family. As the parties are desirous to preserve their marital relationship and resume cohabitation permanently, no purpose will be served by continuing the criminal proceedings arising out of the said FIR. Therefore, I am inclined to allow the petition. Hence, following order:- p. 2 H.C. SHIV 8-WP3913-26.DOC (a) Petition is allowed. (b) The FIR bearing Cr. No.436 of 2022 dated 14.11.2022 registered with Vimantal Police Station, Pune for the offence punishable under Sections 498A, 323, 504 and 34 of the IPC and consequent criminal case bearing R.C.C.
