Accused no.5 in Crime No.221 of 2025 registered by Srirangapatna Rural Police Station, Mandya District for offences punishable under Sections 111, 13, 310(6), 61(1)(a) of BNS 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. The FIR in Crime No.221 of 25 was registered by Srirangapatna Rural Police Station, Mandya District initially, for offence punishable under Section 309(3) of BNS 2023 against unknown persons, based on the first information dated 06.11.2025, received from Smt. Nisarga wife of Shivakumar. During the course of investigation, petitioner herein was arrested on 24.11.2025. After completing investigation, charge - 3 - HC-KAR NC: 2026:KHC:28394 CRL.P No. 5975 of 2026 sheet is filed against six persons. Petitioner is arrayed as accused no.5 in the charge sheet. His bail application filed before the jurisdictional Sessions Court was rejected. It is under these circumstances, he is before this Court. 4. Learned counsel for the petitioner submits that, accused nos.3, 4 and 6 have been now granted regular bail by the jurisdictional Sessions court. He submits that petitioner has no other criminal antecedent. Investigation of the case is completed. Alleged offences are not punishable with death or life imprisonment. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition, however does not dispute the submission made by the petitioner. 6. As per the charge sheet allegation, on 05.11.2025, accused nos.1 and 2 had entered the house of the first informant, while accused nos.3, 4 and 5 were keeping a watch outside and accused no.1 and accused no.2 who had entered the house of the first informant, threatened CW1 and CW2 with deadly weapon, and thereafter committed robbery of their gold - 4 - HC-KAR NC: 2026:KHC:28394 CRL.P No. 5975 of 2026 jewelry, cash and other valuables and had escaped from the house. Undisputedly, petitioner herein had not entered the house on 05.11.2025 and it is only accused no.1 and no.2, who had entered the house and committed the robbery. 7. Accused nos.3, 4 and 6 have been now granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.5112 of 2026 and Crl.Misc.No.5151 of 2026. It is not in dispute that petitioner has no other criminal antecedent. Therefore, the offence punishable under Section 111 of BNS 2023 may not get attracted against him. Investigation of the case is now completed and charge sheet has been filed. Since the other accused as against whom similar allegations are found in the charge sheet have been already enlarged on the bail. I do not find any good ground to deny the very same relief to the petitioner. Under the circumstances, the following order:- ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.221 of 2025 registered by Srirangapatna Rural Police - 5 - HC-KAR NC: 2026:KHC:28394 CRL.P No. 5975 of 2026 Station, Mandya District for offences punishable under Sections 111, 13, 310(6), 61(1)(a) of BNS 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS List No.: 1 Sl No.: 66
