Present C-528 application has been filed seeking a direction to expedite the disposal of Criminal Case No. 7460 of 2020, State Vs. Bhuwan Chandra, under Sections 420, 504 and 506 I.P.C., pending before the court of learned Additional Chief Judicial Magistrate, Haldwani, District Nainital, as expeditiously as possible or within a time frame stipulated by this Court. 4. Learned counsel for the applicant submits that a complaint was filed by the applicant against respondent no.2 arising out of a dispute relating to a land transaction between the applicant and respondent no.2. It is submitted that, pursuant thereto, the learned 2nd Judicial Magistrate, Haldwani, passed the cognizance/summoning order dated 02.12.2020. The said order was challenged by respondent no.2 by filing C-482 No.1858 of 2021 before this Court, which came to be dismissed by a Coordinate Bench of this Court vide judgment and order dated 16.05.2025. 5. Learned counsel for the applicant would further submit that despite dismissal of the aforesaid C-482 application, the complaint case is still pending before the court below and has not been decided till date. It is also submitted that respondent no.2 is unnecessarily delaying the proceedings before the trial court. Owing to such delaying tactics, the applicant, who is about 72 years of age, is facing great hardship and legal prejudice. 6. Having heard learned counsel for the applicant and considering the fact that the case has been pending since the year 2020, this Court deems it appropriate to dispose of the present application with a direction to the court below to expedite the proceedings. 7. Accordingly, the present C-528 application is disposed of with a request to the learned Additional Chief Judicial Magistrate, Haldwani, District Nainital to make every endeavour to decide Criminal Case No. 7460 of 2020, ‘State Vs. Bhuwan Chandra’, as expeditiously as possible, preferably within a period of one year from the date of production of a certified copy of this order. 8.
